Terms of Service

These Terms govern your use of HAPS. Please read them, especially Sections 4, 8, 9, and 17 — they cover your responsibility for the line you're protecting, what HAPS can and can't guarantee, and how disputes are resolved. Questions: haps.helpsupport@gmail.com.

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and Cody Zippe, doing business as HAPS ("HAPS," "we," "us," or "our"), governing your access to and use of haps.help, app.haps.help, and the call-screening service and related features we provide (collectively, the "Service"). By creating an account, subscribing to, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, incorporated here by reference. If you do not agree, do not use the Service.

2. Description of the Service

HAPS is a call-screening service that helps a paying customer ("you," the "Customer") protect a family member's phone line (the "Protected Line") from unrecognized or potentially fraudulent callers. Calls from numbers on your trusted-contact list connect to the Protected Line as usual. Calls from unrecognized numbers are routed to you or another designated family admin, and, if unanswered, to a recorded voicemail. HAPS is a call-routing and screening tool — it does not replace the Protected Line's underlying telephone service, and HAPS is not itself a telephone carrier.

3. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to create a HAPS account. You agree to provide accurate, current, and complete information when registering, and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

4. Your Responsibility for the Protected Line and Consent

You represent and warrant that:

  • You have the legal right and authority to configure call screening on the Protected Line — whether because it's your own line, or because you've obtained the informed consent of the person whose line it is (the "Protected Party") to set up and manage the Service on their behalf;
  • You have informed the Protected Party, to the extent practicable, that incoming calls will be screened and that unrecognized callers may be routed to you and/or recorded when leaving a voicemail;
  • You will promptly remove the Service from a line, or stop using it, if the Protected Party withdraws consent.

HAPS relies on these representations and does not independently verify your authority over the Protected Line or the Protected Party's consent. You agree to indemnify HAPS for any claim arising from a failure to obtain or maintain that authority or consent, as described in Section 15.

5. Acceptable Use

You agree not to:

  • Use the Service to screen or monitor a phone line without the authority or consent described in Section 4;
  • Use the Service to harass, surveil, or control another adult in a manner that violates applicable law;
  • Attempt to circumvent, disable, or interfere with the security or proper functioning of the Service;
  • Use the Service for any unlawful purpose or in violation of applicable telecommunications, privacy, or consumer protection law;
  • Reverse-engineer, resell, or use the Service to build a competing product.

We may suspend or terminate accounts that violate this Section.

6. Subscription, Billing, and Cancellation

  • The Service is offered on a recurring monthly subscription, currently priced per Protected Line as shown at checkout (currently $20/month per Protected Line). Pricing is subject to change; we'll give notice before a price change takes effect for existing subscribers.
  • Your subscription renews automatically each billing cycle until you cancel. You may cancel any time from your dashboard; cancellation takes effect at the end of your current billing period, and we do not provide prorated refunds for partial periods already paid.
  • Payment is processed by Stripe. Subscribing authorizes us, through Stripe, to charge your payment method on a recurring basis until you cancel.
  • If a payment fails, we may suspend screening on the affected Protected Line until payment is resolved. A suspended line's failsafe (Section 8) will connect calls directly, as if the Service weren't present.

7. Free Setup Assistance

Where offered, complimentary setup assistance — such as help building your initial trusted-contact list — is provided on a best-efforts basis and does not create any additional warranty or obligation beyond these Terms.

8. Service Limitations; No Guarantee Against Fraud

HAPS reduces a Protected Party's exposure to unknown and potentially fraudulent callers, but it is not a guarantee that fraud, scams, or unwanted contact will never reach them. Spoofed numbers resembling a trusted contact, contact through channels other than the Protected Line (text, email, in person, a different number), and human error managing the trusted-contact list are all outside HAPS's control. HAPS is one layer of protection, not a substitute for ongoing family communication and vigilance.

Our design intent is for calls to connect directly if our system, our telephony partners, or the underlying network are ever unreachable — but we do not warrant that this failsafe behavior will occur without exception in every circumstance, including outages beyond our control.

9. Emergency Calls

Calls to 911 or other public-safety numbers are intended to always connect directly and are never screened by HAPS. However, HAPS does not provide the underlying telephone or emergency (E911) service — that's provided by the Protected Line's own carrier — and HAPS is not responsible for the availability, accuracy, or performance of 911 or other emergency services on that line. Never rely on HAPS in place of directly contacting emergency services.

10. User Content

If you submit a review, testimonial, or other content to us — for example, through our review submission page — you grant HAPS a non-exclusive, worldwide, royalty-free license to use, reproduce, edit for length or clarity, and display that content on haps.help and in our marketing materials, with the attribution you provide. We review submissions before publishing and may decline to publish, or remove, any submission at our discretion. Do not submit content that is false, defamatory, or that you don't have the right to share.

11. Intellectual Property

The Service, including its software, design, text, graphics, and the HAPS name and logo, is owned by HAPS or its licensors and protected by intellectual property laws. These Terms do not grant you any right to use HAPS's trademarks, logos, or branding without our prior written consent.

12. Third-Party Services

The Service relies on third-party providers, including telephony/carrier partners, Stripe for payments, and cloud infrastructure providers. Your use of the Service may be subject to those providers' own terms — for example, Stripe's terms govern the payment relationship. We are not responsible for the acts or omissions of independent third-party providers.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL PREVENT ALL UNWANTED OR FRAUDULENT CALLS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAPS AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO HAPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify, defend, and hold harmless HAPS and its owner from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms, including the representations in Section 4; (b) your violation of any law or the rights of a third party, including the Protected Party; or (c) your use of the Service.

16. Term and Termination

These Terms remain in effect while you use the Service. You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service, with notice where reasonably practicable. Sections that by their nature should survive termination — including Sections 8, 9, and 13–15 and 18 — will survive.

17. Dispute Resolution; Arbitration Agreement; Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

  • Informal resolution first. Before filing a claim, you agree to contact us at haps.helpsupport@gmail.com and attempt to resolve the dispute informally for at least 30 days.
  • Binding arbitration. If we can't resolve a dispute informally, you and HAPS agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
  • Class action waiver. Any arbitration or proceeding will be conducted only on an individual basis, not as a class, collective, or representative action.
  • Opt-out right. You may opt out of this arbitration agreement by emailing haps.helpsupport@gmail.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out. If you opt out, disputes will instead be resolved in the courts described in Section 18.
  • Exceptions. Either party may seek injunctive or other equitable relief in court to protect its intellectual property or confidential information.

18. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 17, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the Effective Date above and, where appropriate, notify you — such as by email or an in-product notice. Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms.

20. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HAPS regarding the Service.
